Running without the expected EGR valve will cause the computer to store a code 32 and trip the Check Engine light. Operationally this is not a problem, but you don't want that light on all the time, and some states will fail you at inspection for it. I don't know of a way to fool it into submission, so you might want to swap the intake over and connect an EGR.
